Social Serve – Participant Terms, Waiver & Release

THIS IS A LEGAL DOCUMENT. IT CONTAINS A WAIVER OF LIABILITY AND A RELEASE OF CLAIMS. PLEASE READ IT CAREFULLY BEFORE AGREEING.

In this document, “Social Serve” means The Trustee for the Social Serve Trust, ABN 69 129 175 419 trading as Social Serve. “Event” means any Social Serve event I attend and its related activities (including tennis, padel, pickleball, music, and food and drink service). “Organisers” means Social Serve and its trustees, officers, directors, members, employees, volunteers, contractors, agents, sponsors and venue providers, and their successors and assigns.

Eligibility

  1. I am at least 18 years old and will bring valid photo ID to the Event, which may be checked to verify my age.

  2. I am responsible for deciding whether I am fit to take part. I understand the Event involves physical exertion and that I should consult a doctor before taking part in any strenuous physical activity.

Risk warning

  1. I understand that tennis, padel, pickleball and the other activities at Social Serve events are recreational activities that carry an inherent risk of serious injury, illness, permanent disability or death. Courts and other surfaces can be variable and unpredictable, and weather, equipment, other participants and man-made obstacles can change without notice. I voluntarily accept these risks.

  2. I understand the Event may involve the consumption of alcohol, and that alcohol can increase these risks. I am responsible for how much I drink and for my own behaviour.

Waiver, release and indemnity

  1. To the maximum extent permitted by law, I release the Organisers from, and waive any claim I may have against them for, death, injury, illness, loss or damage to me or my property (and any related costs, including legal fees) arising from my attendance at or participation in any Event, whether as a participant, spectator or otherwise, including where caused by the negligence of an Organiser.

  2. To the maximum extent permitted by law, I agree to indemnify the Organisers against any loss, liability or cost they incur as a result of my actions or my breach of these terms, including damage I cause to any property or facilities.

  3. This release binds me and my heirs, executors, administrators, successors and assigns.

  4. Nothing in these terms excludes, restricts or modifies any right I have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified by agreement.

Safety and conduct

  1. I will follow the rules, regulations and reasonable instructions of the Organisers and the venue.

  2. I am responsible for deciding whether the court, weather or any facility is too dangerous for me to continue playing, and I will stop if it is. The Organisers may also pause, modify or cancel play for safety reasons.

  3. The Organisers may refuse entry to, or remove, anyone who is unsafe, intoxicated or disruptive, without refund.

  4. If I am injured or become unwell, I consent to the Organisers arranging first aid or medical treatment they consider advisable, and to calling emergency services on my behalf.

Property

  1. I am responsible for my personal belongings and equipment at all Events. I am also liable for any damage I cause to property or facilities.

Photos and video

  1. I consent to Social Serve and its venue and sponsor partners photographing and filming at the Event and using my name, image and voice in photos, video, social media, websites, advertising and the press to promote Social Serve and its events, without payment. If I do not want to be photographed, I will tell a Social Serve team member at the Event.

Tickets

  1. My ticket is non-transferable and non-refundable, except where Social Serve approves a transfer, where Social Serve cancels or materially changes the Event, or where a refund is required by law.

Privacy and updates

  1. Social Serve will collect and use my personal information to run the Event, for safety and for administration, in line with its Privacy Policy. I may also choose to receive news of future Social Serve events by ticking the separate opt-in box at checkout. I can unsubscribe at any time.

Agreement

  1. By agreeing to this waiver, I confirm that I have read and understood it, that I am agreeing to it voluntarily, and that it is legally binding on me.
